Will AI replace mediators and arbitrators? The data

Updated

Arbitrators, mediators and conciliators help people settle disputes through dialogue instead of a trial. Mediators guide the parties toward their own agreement, while arbitrators hear both sides and make a decision. AI tools can sort documents and draft summaries. Building trust between people in conflict, and deciding a case fairly, stays with a human.

The short answer: AI can help with the paperwork, not the people. The ILO's 2025 index rates legal professionals not elsewhere classified, the closest group, at minimal exposure with a score of 0.37. The US Bureau of Labor Statistics projects 5 percent growth for arbitrators, mediators and conciliators from 2025 to 2035, faster than average, with about 300 openings a year. Projections are estimates, not guarantees.

How exposed mediators are

The International Labour Organization scores occupations' tasks from 0 (cannot be automated with generative AI) to 1 (could be done without a human operator), and groups them into gradients from 1 to 4, with 4 the most exposed; below them sit minimal exposure and not exposed (ILO Working Paper 140, 2025).

The ILO scores groups of occupations, so this is the closest group for arbitrators, mediators and conciliators, not a score for the job title itself.

The BLS says these methods are often quicker and less expensive than trials, and that many contracts, such as those for employment and real estate, require mediation or arbitration. It adds that public sector work depends on state and local government budgets. Its outlook does not mention AI.

Where AI is helping

  • Organizing case files, exhibits and timelines.
  • Drafting first versions of summaries and agreements.
  • Scheduling sessions and handling routine messages.

What stays with mediators

  • Trust: getting people in conflict to talk and listen.
  • Neutrality: staying fair to both sides and being seen as fair.
  • Decisions: arbitrators answer for the award they make.
  • Checking AI help: generated summaries and legal points can be wrong, which NIST calls confabulation (NIST AI 600-1). See checking AI output.

How the job is changing

AI can take on some of the document work around a case. Parties in a dispute may also want to know whether AI was used and how their confidential information was handled. This page is general information, not career advice.

Pay and how to get in

The US Bureau of Labor Statistics puts the median annual pay for arbitrators mediators and conciliators at $75,530 in May 2025, against $50,980 for all workers. The typical education needed to enter is: bachelor's degree. See how this job compares in AI exposure by pay and AI exposure by education level.
